During the IX LAAD Security Seminar, the panel “Technologies applied to preventive policing: Allies or Rivals?” was attended by the president of the OAB SP Military Criminal Law Commission, Larissa Torquetto Teixeira, Major Adriana Leandro de Araújo, the PM’s operational coordinator, Judge Ulysses Gonçalves, representing the National Policy and Penitentiary Council, and lawyer, economist and professor Renato Opice Blum. The three of them analyzed the chain of custody and the LGPD and their relationship with the images captured by the body cameras used by police officers.

According to Blum, in the public environment there is no privacy and the LGPD does not apply, especially in the case of public security, for which the law exceptionally does not apply. However, the expert also stressed the importance of preserving the chain of custody and all stages of digital evidence by means of documentation based on protocols in the different areas of activity, while emphasizing the risk of contradiction when this data is processed in administrative environments where the LGPD is applicable. He mentioned that the governance proposed by the Brazilian Artificial Intelligence Law, which should be approved soon, is positive for public security.

Major Adriana Leandro de Araújo, the PM’s operational coordinator, explained the process involved in the chain of custody of the images obtained by the body cams used by police officers, and the technical characteristics of the security protocols that involve the protection, safekeeping and inviolability of the content captured.

Judge Ulysses Gonçalves highlighted the gain in quality of police activity with the use of technological resources, such as equipment for monitoring sentenced prisoners, for example, which allows police officers to pay more attention to the main duties of their job.

For him, the use of cameras by police officers should not only be seen from a repressive, punitive and stationary point of view, which discourages militia members. The institute of the camera or any other technological device is also an element of proof of the approach itself and facts of the crime scene, which serve as a benefit to the police officer himself as a defense tool to show responsibility in relation to unconstitutionalities or violation of laws.
